Title IX

“No person in the United States shall, on the basis of sex, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any education program or activity receiving Federal financial assistance.”

Title IX Office Mission Statement

Colorado School of Mines is committed to creating and maintaining an environment free of gender and sex-based discrimination, sexual harassment, sexual assault, and interpersonal violence (dating/domestic violence and stalking). Such behaviors are not tolerated at Mines and are prohibited both by law and by Mines’ policies. The University will respond promptly and effectively to reports of gender and sex-based discrimination, sexual harassment, sexual violence, dating/domestic violence, and stalking, and will take appropriate action to prevent, to correct, and, when necessary, to discipline behavior violating Mines policies. Relevant policies that address these issues are below.

Mines Consent Definition

Consent is positive, unambiguous, and voluntary agreement to engage in specific sexual activity throughout a sexual encounter.

Consent must be affirmative. Consent consists of an outward demonstration indicating an individual has freely chosen to engage in sexual activity. Relying on non-verbal communication can lead to misunderstandings. Silence, in and of itself, cannot be interpreted as Consent. Consent may not be inferred from silence, passivity, lack of resistance, or lack of an active response alone. A person who does not physically resist or verbally refuse sexual activity is not necessarily giving Consent.

Consent cannot be inferred in the context of a current or previous sexual relationship.

Consent to some sexual acts does not imply consent to others. 

Past consent to a given act does not imply or grant present or future consent. 

Consent must be ongoing throughout a sexual encounter and can be revoked at any time.

Consent cannot be obtained by fear, threat, coercion, intimidation, and/or force.

Consent cannot be obtained from someone who is Incapacitated as that term is defined in these procedures. 

Consent cannot be obtained from someone who is not of legal age.

Title IX Athletic Compliance

体育比赛投注比例Athletic compliance under Title IX covers two basic provisions for male and female students: 1.) equal access to the programs and 2.) equal treatment once in the programs. Athletic programs evaluate equal access and equal treatment via the following categories:

  1. Accommodation of Interests and Abilities
  2. Athletic Financial Assistance
  3. Other Athletic Benefits and Opportunities
    1. Equipment and supplies
    2. Scheduling of games and practice times
    3. Travel and per diem allowances
    4. Tutoring
    5. Coaching
    6. Locker rooms, practice and competitive facilities
    7. Medical and training facilities and services
    8. Housing and dining facilities and services
    9. Publicity
    10. Support services
    11. Recruitment of student-athletes

The Office for Civil Rights (OCR) is responsible for the enforcement of the Title IX and responds to complaints, conducting reviews and providing assistance.

Pursuant to Title IX of the Education Amendments of 1972, 20 U.S.C. § 1681, and 34 CFR Part 106, Mines does not discrimination on the basis of sex in any of its education programs or activities, including admissions and employment.
